مطالعه راهکارهای پیشنهادی موسسه حقوقی آمریکا و موسسه حقوقی مکس پلانک آلمان در تعیین قانون حاکم بر نقض همزمان علائم تجاری در فضای مجازی

چکیده

اصل بر سرزمینی بودن حمایت از علائم تجاری است. مطابق با این اصل علامت تجاری تحت حمایت قانونی سرزمین محل ثبت است. با این حال با پیشرفت تکنولوژی و حدوث اشکال جدید آن از جمله فضای مجازی بعلت بی معنا بودن سرزمین در این فضا، مساله تعیین قانون حاکم بر نقض علائم تجاری با چالش مواجه شده است به خصوص در نقض هایی که به صورت همزمان با یک کلیک ناقض در چندین کشور و یا حتی در سطح جهان واقع می شود راهکاری در کنوانسیون های بین المللی و یا قوانین موضوعه کشورهای جهان ارائه نشده است. در این موارد موسسه حقوقی آمریکا و موسسه حقوقی مکس پلانک آلمان ضمن حمایت از اصل سرزمینی بودن حمایت از علائم تجاری در مساله نقض همزمان علائم تجاری در فضای مجازی قانون کشور با نزدیکترین ارتباط و قانون کشوری که فعل اساسی نقض یا آثار اساسی و مهم نقض در آن کشور واقع شده و یا تجارت آن متاثر شده است پیشنهاد می دهند.

In the international system of protection of trade marks Is based on the principle of territoriality of the rights it means the country that the right is created in it, determine the limitation of protection and the mark out of this country has not validity.
