Arbitrability of Banking Disputes Under Iranian Law

Abstract
This article examines the legal feasibility of submitting banking disputes to arbitration and addresses the associated challenges. The authors have analyzed banking laws and regulations, the Civil Procedure Code, and arbitration provisions to evaluate both the obstacles to arbitrability in banking disputes and potential solutions. Furthermore, the study explores the advantages and disadvantages of arbitration within this specific legal framework. The potential for arbitrability is also assessed in light of the recently enacted Central Bank law. Therefore, the primary question of this research is whether banking disputes can be referred to arbitration. The paper elaborates on the nature of arbitration and banking arbitration under Iranian law, providing practical solutions to address existing obstacles. It discusses the benefits and drawbacks of arbitration in this important area of law. The potential for arbitrability is also analyzed in light of the recently enacted Central Bank law.
