Third Party Intervention in the Arbitration Process in the Regulations of International Arbitration Organizations and Iranian Legal System

Abstract

The intervention of third parties in the arbitration process is one of the most controversial issues in the field of international commercial arbitration. Because third-party participation beyond the its scientific importance carries important practical consequences for the parties in international arbitration proceedings. At first glance, the presence of third party with a contractual dispute resolution system by arbitration seems incompatible. However, with the increase of multilateral disputes in international commercial transactions and the expansion of the use of arbitration conditions, international arbitration organizations are increasingly facing the issue of third-party intervention in the arbitration process. This research intends to examine the issue of third-party intervention in arbitration with a different approach, primarily from the perspective of the regulations of international arbitration organizations, and then on the basis of Iranian laws, and then to discuss  its limitations and obstacles. The findings of the present research show that although the extension of the arbitration agreement to the third-party, has been accepted in the field of international arbitrations based on several legal doctrines; But in the Iranian legal system, a single procedure cannot be considered as the rule on this issue due to the conflicting opinions in this regard. However, the existence of the element of satisfaction as the main indicator of arbitration, makes it necessary to provide justified and specific grounds for expanding the scope of arbitration to third parties. The most important of these basics are; Representation is the staple rule and the beneficiary that was discussed.
