Complementary software and hardware must be interoperable in terms of functionality. The specific nature of computer software causes network effects and mass production savings in software industry. The majority of software right abuse arises when the developer conditions licensing a software on the complementary software and hardware that makes it impossible to buy these products independently. Such condition in license agreements of computer software violates U.S antitrust laws provided that the developer has tied independent products and the seller has essential market power in the created products market. This condition has different competitive effects. In the Iranian law, the Act on the implementation of article 44 of the constitution which has stated the basic rules of competition, has not dealt with the issue perfectly and there are provisions in the Act on computer software developers and its by-law on interoperability. Given the absence of independent studies in this field, analysis of rules can lead to clarification of the subject. شرکت‌های نرم‌افزاری گاهی فروش نرم‌افزار رایانه‌ای را به دریافت قطعات سخت‌افزاری مشروط می‌کنند یا هنگام طراحی محصول، نرم‌افزار رایانه‌ای را با نرم‌افزار و سخت‌افزار مکمل ادغام می‌کنند. سخت‌افزار و نرم‌افزار مکمل باید از لحاظ کارکردی سازگار باشند. ماهیت خاص نرم‌افزار رایانه‌ای منجر به ایجاد آثار شبکه‌ای و صرفه‌جویی‌های حاصل از تولید انبوه در صنعت نرم‌افزار می‌شود. شرط یادشده از دو دیدگاه سوء‌استفاده از حق‌مؤلف و ضدانحصار قابل بررسی است. اکثر دعاوی سوءاستفاده از حق‌مؤلف نرم‌افزار رایانه‌ای زمانی مطرح می‌شود که مجوز بهره‌برداری از یک نرم‌افزار به صورتی به نرم‌افزار و سخت‌افزار مکمل وابسته شود که امکان خرید جداگانه این محصولات وجود نداشته باشد. هرگاه محصولات متمایز به هم وابسته شوند و مجوزدهنده دارای قدرت بازار قابل توجه در بازار محصول خلق‌شده باشد چنین شرطی قوانین ضدانحصار آمریکا را نقض می‌کند. این شرط دارای آثار رقابتی متفاوتی است و بسته به مورد، نحوه برخورد با آن در حقوق آمریکا متفاوت است. حقوق رقابت ایران تا حدودی به این شرط پرداخته است ولی نقایصی دارد که باید برطرف شود. از نظر حقوق مالکیت ادبی و هنری، در مقررات مربوط احکامی راجع به سازگاری وجود دارد اما به موضوع سوء‌استفاده از حق پرداخته نشده که پیشنهاد می‌شود احکام آن به‌روشنی بیان شود. https://pajooheshnameh.itsr.ir/article_36981_7a94c12518b17784a31f20eb6ceeff64.pdf
