For the sake of assurance as to access to such patent, standard organizations have required the owners to undertake to grant license on this basis is to prevent owners of standard essential patents from abusing their exclusive power in the market and committing anti-competitive acts. Meanwhile, they are entitled to earn appropriate remuneration for their essential patents. There are controversies as to conditions of the said obligations. There have been a number of cases which present a common practice with regard to preventing abuse of excusive power and anti-competitive acts. The results of this analytic-descriptive study show the importance of a balance between the interests of standard essential patents owners and those enforcing standards and in order to preserve competition, the conditions of granting licenses must be determined clearly. In the absence of specific provisions, in the Iranian law, in order to regulate standard essential patents, recourse may be made to the rules on compulsory licenses and prevention of abuse of dominant position in the act on the implementation of article 44 of the constitution. Meanwhile, specific provisions for standard essential patents would clarify the legal status of such patents and reduce disputes. با فراگیر‌شدن فناوری‌های استاندارد در همه زمینه‌ها، به ویژه فناوری ارتباطات، اهمیت اختراعات ضروری استاندارد افزایش یافته است. جهت اطمینان از دسترسی به این اختراعات، سازمان‌های استانداردسازی دارندگان را متعهد می‌کنند مجوز بهره‌برداری از اختراعات ضروری خود را با شرایط  منصفانه، متعارف و غیرتبعض‌آمیز صادر کنند. تعهد به صدور مجوز براساس این شرایط برای جلوگیری از سوء‌استفاده دارندگان اختراعات ضروری از قدرت انحصاری در بازار و انجام اقدامات ضدرقابتی است. در عین حال، دارندگان مستحق دریافت پاداش مناسب برای اختراعات ضروری خود هستند. راجع به شرایط تعهدات فوق‌الذکر اختلافاتی وجود دارد. البته دعاوی قضایی در این زمینه مطرح شده که یک رویه مشترک در خصوص عدم سوء‌استفاده از قدرت انحصاری و اقدامات ضدرقابتی از آن قابل استنباط است. نتایج این پژوهش که به روش تحلیلی توصیفی انجام شده حاکی از آن است که ایجاد تعادل بین منافع دارندگان اختراعات ضروری استاندارد و مجریان استاندارد اهمیت زیادی دارد و به منظور حفظ رقابت، شرایط صدور مجوز بهره‌برداری باید به روشنی تعیین شود. در فقدان نص قانونی خاص، در حقوق ایران برای ساماندهی اختراعات ضروری استاندارد می‌توان به مواردی از جمله مجوزهای اجباری حق اختراع و قواعد منع سوء‌استفاده از وضعیت اقتصادی مسلط قانون اجرای سیاست‌های کلی اصل 44 استناد کرد. در عین حال، تدوین مقررات ویژه برای اختراعات ضروری استاندارد موجب تبیین وضعیت قانونی این اختراعات و کاهش اختلافات و دعاوی خواهد شد. https://pajooheshnameh.itsr.ir/article_33537_bb230dffabdb3f62c65202031ce32653.pdf
