The specific features of this arbitration method have led to many legal debates. Due to the lack of physical location in online arbitration, the way of determining the seat of this type of arbitration should be analyzed. The seat of arbitration is fundamental in defining the legal framework for arbitral proceedings. The basic question of the present research is how and by what criterion the seat of arbitration in such type of arbitration can be determine? The article concludes that if the disputing parties determine seat of arbitration, the parties’ agreement is valid, according to absolute delocalization theory, in spite of the lack of physical location in online arbitration. If the seat is not clearly identified by the parties’ agreement, arbitrator must choose seat of arbitration. Various criteria have been studied in this regard, but it seems that suitability of national legal framework of seat, procedural governing law and party’s choice of judicial forum, are useful for detection of implicit parties’ intention. In spite of suggestion of the abovementioned criteria, the analyses and findings of this article show that explicit regulation by the legislator on this issue is essential یکی از رایج‌ترین طرق حل و فصل اختلافات، داوری است و داوری بر خط یک روش نوظهور در این حوزه می‌باشد. ویژگی‌های خاص این روش داوری، باعث طرح مباحث حقوقی بسیاری شده است. با توجه به فقدان محل فیزیکی در داوری‌های برخط، نحوه تعیین مقر در این نوع داوری‌ها موضوعی است که باید مورد بررسی قرار گیرد که با درنظرگرفتن آثار حقوقی مهم مقر در فرایند داوری، تعیین آن حائز اهمیت می‌باشد. سوال اساسی پژوهش حاضر آن است که چه شخصی و با چه معیاری می‌تواند مقر داوری را در چنین داوری‌هایی تعیین نماید؟ در پاسخ اجمالاً مقاله به این نتیجه نائل شده که در صورت تعیین مقر داوری توسط طرفین دعوا، وفق نظریه محل‌زدایی مطلق، توافق طرفین معتبر بوده و عدم‌وجود مکان فیزیکی در داوری‌های برخط ایجاد مشکل نمی‌کند. در صورت عدم انتخاب مقر داوری توسط طرفین، داور بایستی مقر را انتخاب نماید. معیارهای مختلفی در این خصوص مورد بحث قرار گرفته است اما به‌نظر می‌رسد  معیارهای مناسب بودن مقر از لحاظ حقوقی، قانون شکلی حاکم بر فرایند داوری و دادگاه صالح انتخابی توسط طرفین جهت نظارت بر داوری، بیشتر می‌توانند در کشف اراده ضمنی طرفین در این خصوص راهگشا باشند. علی رغم پیشنهاد معیارهای مذکور، تحلیل و یافته‌های مقاله حاضر نشان می‌دهد که تقنین صریح توسط قانون‌گذار در خصوص این مسئله ضرورت دارد. https://pajooheshnameh.itsr.ir/article_246912_5e5dd742ebb57e333ace01cf27308acc.pdf
