One of the requirements for implementing this policy is the expansion of electronic signatures. In addition to the technical and economic infrastructure, legal aspects are also undeniable because the signatories should be familiar with their rights and duties towards this type of signature. Electronic signatures are divided into two generic digits, common and binary. Binary signatures are a simple form of electronic signatures that have been used in online sales, transactions that are not sensitive and used in electronic procedures. Digital signatures are generally divided into two types of biometrics and digitization in a special sense. Its biometric type has been used extensively in the legal system of Iran and is legally accepted in almost all aspects of the legal system, including electronic filing, registration of intellectual property and transactions, and its digital form in the US legal system is used as the main tool for concluding intelligent contracts in the new exchange trading system. The question we are looking at in this article is whether the Iranian legal system has clear and practical rules for electronic signature types. The hypothesis of this paper is a negative answer to the above question. This article is presented in a comparative manner in three sections: Electronic Signature Review in the United States, Iran, and Electronic Signature Scoring.}, keywords = {Digital Signature / Binary Signature / Smart Contract / Iranian Law / American Law}, title_fa = {خطرات حقوقی امضای الکترونیکی و الزامات قانونی پیشگیری از آنها: مطالعه تطبیقی در حقوق ایران و آمریکا}, abstract_fa = {مطابق قانون تجارت الکترونیکی ایران مصوب 1382، وزارت صنعت، معدن و تجارت (وزارت بازرگانی سابق) متولی گسترش تجارت الکترونیکی در کشور است. یکی از ملزومات تحقق این سیاست، گسترش امضای الکترونیکی می‌باشد. برای گسترش این امضا علاوه بر زیرساخت های فنی و اقتصادی، جنبه‌های حقوقی نیز اهمیت دارد؛ زیرا صاحبان امضا باید با حقوق و تکالیف خود نسبت به این نوع امضا آشنا باشند. امضای الکترونیکی به دو گروه باینری و دیجیتالی به معنای عام تقسیم می‌گردد. امضاهای باینری صورت ساده از امضاهای الکترونیکی می‌باشند که در خرید و فروش‌های اینترنتی، انجام معاملات فاقد حساسیت و در دادرسی الکترونیکی نیز مورد استفاده قرار می‌گیرند. امضاهای دیجیتالی در معنای عام به دو نوع بیومتریکی و دیجیتالی در معنای خاص تقسیم می‌شوند. نوع بیومتریکی آنها در نظام حقوقی ایران کاربرد فراوان داشته و در بیشتر جنبه‌های حقوقی این نظام از جمله ثبت الکترونیکی اسناد، ثبت مالکیت‌های فکری و انجام معاملات، مورد پذیرش قرار گرفته است. نوع دیجیتالی آن در نظام حقوقی آمریکا به‌عنوان اصلی‌ترین ابزار انعقاد قراردادهای هوشمند در نظام نوین مبادلاتی به کار گرفته می‌شود. سوالی که در این مقاله به دنبال آن هستیم این است که آیا نظام حقوقی ایران دارای مقررات روشن و کاربردی در زمینه انواع امضای الکترونیکی است یا خیر؟ فرضیه اثبات شده این نوشتار، پاسخ منفی به سوال فوق است. این مقاله با روش کتابخانه‌ای و تطبیقی در سه بخش به بررسی امضای الکترونیکی در آمریکا، ایران و درجه بندی امضای الکترونیکی پرداخته است.}, keywords_fa = {امضای دیجیتالی / امضای باینری / قرارداد هوشمند / حقوق ایران/ حقوق آمریکا}, url = {https://pajooheshnameh.itsr.ir/article_242101.html}, eprint = {https://pajooheshnameh.itsr.ir/article_242101_b65ca8fd4093ca0eb8362ecc5dac6952.pdf} }
