چکیده

یکی از پرسش‌های دائمی درمورد حقوق مالکیت فکری این است که نقش حقوق مالکیت فکری در توسعه اقتصادی کشورها چیست و چه نوع نظام حقوق مالکیت فکری برای کشورهای درحال‌توسعه مفیدتر است. برای پاسخ به این پرسش دوگانه، در پژوهش حاضر از یک‌سو به بررسی مطالعات و تحقیقات تجربی درمورد آثار درون‌زاد و برون‌زاد حقوق مالکیت فکری و از سوی دیگر به بررسی سیر تحول نظام حقوق مالکیت فکری سه اقتصاد نوظهور هند، کره‌جنوبی و چین پرداخته شده تا رهنمودهایی درمورد ایران ارائه شود. یافته‌های پژوهش نشان می‌دهد که حقوق مالکیت فکری تأثیری مثبت بر توسعه اقتصادی داشته و کشورهای درحال‌توسعه بهتر است هماهنگ با توسعه اقتصادی خود به تقویت نظام حقوق مالکیت فکری خود بپردازند.

Appropriate Intellectual Property Rights Regime for Developing Countries: With Suggestions for Iran

چکیده [English]

One of the persisting questions as regards to the intellectual property rights (IPR) has been the dual question concerning the role of IPR in economic development and the appropriate IPR regime for developing countries. To answer this question, we have embarked on a twofold exploration of the empirical research on emerging economies of China, India and South Korea on the other. Research findings suggest that IPR protection generally contributes to economic development and developing countries are recommended to reinforce their IPR regimes in parallel with their economic development.
