Authorized licenses will be awarded to them if their tenants are approved by the competent authorities for the transaction, so that if such person is not registered or his / her affiliation goes away later, such authorization will not be assigned to him / her or canceled.This condition must also be complied with if the individual or legal person concludes his or her transactions by Decentralized Autonomous Organizations. In certain circumstances, there is also the possibility of discovering the trading side through Oracle. This research examines the mechanism of concluding and operating smart contracts by explaining how these contracts are recognized in Iran's legal system.}, keywords = {"Capacity","Smart Contracts","Digital Signature","Digital Cryptocurrencies","Decentralized Autonomous Organizations"}, title_fa = {واکاوی مکانیسم احراز اهلیت متعاملین در پیاده سازی قراردادهای هوشمند در حقوق ایران}, abstract_fa = {مطابق با ماده 79 قانون تجارت الکترونیکی مصوب سال 1382، وزارت صنعت، معدن و تجارت متولی پیاده سازی ابزارهای مرتبط با حوزه تجارت الکترونیکی در ایران است. جدیترین نوع ابزارهای الکترونیکی مورد استفاده در جهان قراردادهای هوشمند هستند که از سال 2016 وارد نظام حقوقی آمریکا و پس از آن در دیگر کشور های توسعه یافته به کارگرفته شده اند. قراردادهای هوشمند قراردادهایی هستند که در یک بستر عمومی نامتمرکز منعقد، سپس مالکیت عوضین در آنها به صورت خودکار به طرفین معامله منتقل و در نهایت در بستر بلاک چین ثبت و عرضه می شوند. احراز اهلیت متعاملین در قراردادهای هوشمند نسبت به اشخاص حقیقی و حقوقی در دو مرحله پیش از معامله و هنگام آن مطرح می گردد. افراد برای انعقاد این عقد باید نسبت به اخذ مجوز استفاده از امضای دیجیتالی و تملک ارزهای مجازی اقدام نمایند. مجوزهای بیان شده در صورتی به آنان تعلق می گیرد که اهلیت آنها برای معامله از سوی مراجع صالح تایید گردد به گونه ای که اگر فردی فاقد اهلیت بوده یا اهلیت وی بعدها زایل شود، چنین مجوزی به وی تعلق نگرفته یا باطل می شود. این شرایط در صورتی که شخصی حقیقی یا حقوقی معاملات خود را توسط سازمان های مستقل نامتمرکز منعقد نماید نیز باید رعایت گردد. در شرایط خاص امکان کشف اهلیت طرف معامله از طریق اوراکل ها نیز موجود است. این تحقیق با بررسی مکانیسم انعقاد و عملکرد قراردادهای هوشمند به دنبال بیان چگونگی احراز اهلیت این قراردادها در نظام حقوقی ایران می باشد.}, keywords_fa = {اهلیت,قراردادهای هوشمند,امضای دیجیتالی,ارزهای رمزنگاری شده دیجیتالی,سازمان های مستقل نامتمرکز}, url = {https://pajooheshnameh.itsr.ir/article_245373.html}, eprint = {https://pajooheshnameh.itsr.ir/article_245373_4c8bf3e23edf418f68a0feb4fb0832a0.pdf} }
