In such situation, if obligor of an international commercial contract refused to perform his/her contractual obligations due to the imposition of a sanction, the obligee would have the right to invoke some of the remedies for breach of the contract. The main question of the this research is that in the disputes and contracts which are under scope of application of the United Nation Convention on the Contracts for the International Sale of Goods, even if because of a sanction the obligor was granted an exemption from paying damages for breaching of a contract by a competent authority (the court, arbitrator or arbitral tribunal) could obligee invoke the right to declare price reduction as remedy? In general, the answer is yes. However, in order to explain the conditions, specifications, and the effects of this remedy three assumptions have been distinguished in this paper: 1) the sanction affects entire performance, 2) the sanction affects the performance partially and the performance is inseverable, and 3) the sanction affects the performance partially and the performance is severable.  }, keywords = {Sanction / Price Reduction / the United Nation Convention on Contracts for the International Sale of Goods / Non,conforming Delivery}, title_fa = {حق استناد به کاهش ثمن برای متعهدله در نتیجه وضع تحریم‌های تجاری در کنوانسیون سازمان ملل متحد راجع به قراردادهای بیع بین‌المللی کالا}, abstract_fa = {تحریمی که پس از انعقاد یک قرارداد وضع می‌شود آثار متعددی بر روند اجرای تعهدات ناشی از آن می‌گذارد. در این وضعیت اگر متعهد یک قرارداد بازرگانی بین‌المللی به دلیل وضع یک تحریم، از اجرای تعهدات قراردادی‌اش خودداری کند، متعهدله در مقابل، حق استناد به بعضی از طرق جبرانی نقض قرارداد را دارد. پرسش اصلی که این پژوهش به پاسخ آن می‌پردازد این است که در دعاوی و قراردادهایی که تحت شمول کنوانسیون سازمان ملل راجع به قراردادهای بیع بین‌المللی کالا قرار می‌گیرند، حتی اگر متعهد به دلیل تحریم، توسط مرجع صلاحیت‌دار (دادگاه، داور یا دیوان داوری صالح) از پرداخت خسارات برای نقض قراردادی معاف شود، آیا متعهدله می‌تواند به حق اعلام کاهش ثمن به‌عنوان یک طریق جبرانی استناد کند؟ به‌طورکلی پاسخ این پرسش مثبت است لیکن برای تبیین شرایط، ویژگی‌ها و آثار اعمال این طریق جبرانی در این مقاله سه فرض از هم تفکیک شده‌است: 1)تحریم بر کل اجرا اثر بگذارد، 2)تحریم بر جزئی از اجرا اثر بگذارد و اجرا غیرقابل‌تفکیک باشد، 3)تحریم بر جزئی از اجرا اثر بگذارد و اجرا قابل‌تفکیک باشد.}, keywords_fa = {تحریم / کاهش ثمن / کنوانسیون سازمان ملل راجع به قراردادهای بیع بینالمللی کالا / تحویل غیرمنطبق}, url = {https://pajooheshnameh.itsr.ir/article_242098.html}, eprint = {https://pajooheshnameh.itsr.ir/article_242098_05dea936596abde9fd5a242e44203402.pdf} }
